Terms & Conditions

of the Sarasate Academy, August 03, 2024

1. Summary of Service

Once per year, the Sarasate Academy, represented by the artistic director Kirill Troussov and the directors Paloma Pierzchala and Eduardo González, (in the following referred to as "Sarasate Academy") organizes string master classes (in the following referred to as "academy days") for international participants (in the following referred to as "students"). Each master class consists of several individual lessons held at different locations in Madrid, Spain. These lessons may be held in private or publicly, including instant or later broadcasting or publishing on the Internet or in other media.

All relevant information about the annual academy days will be published in advance on the official application page at https://sarasate.academy. This information includes — but is not limited to — location, dates, times, instructors, prices, deadlines and further details.

2. Application & Payment

2.1. Application & Confirmation

Unless an explicit exception is made, students must apply for the academy days via the official online application page of the Sarasate Academy. Applications by e-mail or other forms of communication are not accepted. Incorrect or missing data in the application form may lead to rejection.

An application does not guarantee participation. Each instructor of the academy days will select the final participants of his/her master class and will inform the students accordingly. The Sarasate Academy reserves the right to reject applicants without explanation. All decisions of the Sarasate Academy are final. Legal recourse is excluded.

2.2. Payment

After the Sarasate Academy has confirmed the participation in the academy days, the student is required to pay the participation fee meeting the deadline published on the application page.

Payments must be made by PayPal, credit card or bank transfer. The student will receive all necessary details by e-mail. Failure to pay within the given time frame may lead to immediate exclusion from the academy days.

3. Cancellation

3.1. Cancellation by Student

Cancellations will only be granted under very special circumstances and only until 60 days prior to the academy days. After this period the student must pay the master class and all associated services in full. Failing to do so may lead to an indefinite exclusion from all future academy days of the Sarasate Academy or other partner academies.

Nevertheless, in case of a cancellation, the Sarasate Academy will make best efforts to find a replacement student. The Sarasate Academy reserves the right to charge a cancellation fee, according to applicable law.

3.2. Force Majeure

Unforeseen circumstances beyond the Sarasate Academy's control may force the Sarasate Academy to cancel the academy days, a specific master class, individual lessons or other parts of the overall service. In such a case, apart from a partial or total refund, the student may not claim and will not receive any further compensation.

Any necessary location change within a radius of 100 km or any time change within one week is no valid reason for a cancellation by the student.

4. Master Classes & Chamber Music

4.1. Instructors

Master classes will be given by the instructors listed on the application page. Should an instructor not be able to hold a master class or individual lesson(s) the Sarasate Academy will make best efforts to provide a replacement instructor of similar international renown and/or similar teaching qualities. A change of instructor is no valid reason for a cancellation by the student or a compensation whatsoever.

4.2. Lessons

Unless stated otherwise, a master class consists of 4 individual lessons with a duration of 45 minutes each. Lesson times and locations will be announced before and/or during the academy days. They can be subject to change any time. Students who fail to attend their lesson(s) may not claim any financial reimbursement or other form of compensation.

4.3. Chamber Music

In addition to the master classes, the Sarasate Academy consists of chamber music projects, that may consist of lessons, rehearsals, private concerts and public performances, such as the official closing concert. Participation in these chamber music projects is mandatory for all students. They will be given by a dedicated chamber music teacher and/or the accompanying pianists. Times and locations will be announced before and/or during the academy days. They can be subject to change any time.

5. Publishing Rights

5.1. Recording & Publishing

With his/her application the student grants the Sarasate Academy the right to record impressions of the master classes, the concerts and all other activities during the academy days for educational or advertising purposes, including — but not limited to — photos, videos and/or audio recordings, including recordings that depict the student and/or his/her performance.

The student also grants the Sarasate Academy the indefinite right to publish and distribute such recordings in all existing or future media, including — but not limited to — YouTube, Vimeo, Facebook, Instagram, websites of the Sarasate Academy and its partners, Television, ads, magazines and/or newspapers. These publications may contain the original recordings, excerpts or modifications, and the recordings may be combined with recordings of other students or with other works.

5.2. Royalties

The Sarasate Academy may record and publish all activities described in 5.1., free of charge. The student will receive no royalties or other form of compensation.

5.3. Rights of the Student

The Sarasate Academy grants the student the right to take photos during the academy days and to publish these photos on his/her social media channels or personal website. The student may not publish photos elsewhere or record/publish video or audio without written approval by the Sarasate Academy.

5.4. Common Interest

Both the student and the Sarasate Academy agree that any published material shall show the depicted persons and/or their performance in a manner that does not harm the reputation or career of the depicted persons, of the Sarasate Academy or of any associated persons, companies, schools, institutes or similar entities.

5.5. Penalties

Photography, videography, audio recordings and the processing & publishing of such media are related to very high costs, covered by the Sarasate Academy and public funding. Should a student revoke the rights mentioned above and should an applicable law require the Sarasate Academy to comply, this revocation would result in a significant damage to the Sarasate Academy.

Therefore, in such a case, the Sarasate Academy will withdraw any benefits the student has received as a result of his/her participation in the academy days, including — but not limited to —  scholarships, certificates, awards and publication rights. Should such benefits have already been paid/given they must be returned by the student. The student will also be excluded indefinitely from all future academy days of the Sarasate Academy and of partner academies.

6. Severability Clause

The Sarasate Academy will observe all legal obligations that may result from Spanish, European or international law. In case any provision of this agreement shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
